Amicable settlement of disputes regarding payment for unauthorized use of property

As we informed in a post, which can be read here, the Law Firm’s lawyers successfully and finally concluded a long-standing legal dispute regarding the payment for unauthorized use of municipal properties, which were partially occupied during the construction of one of the largest shopping malls in the Podkarpackie Voivodeship.

The final dismissal of the lawsuit filed against the Client was significant not only because the Client was not required to make a payment to the municipality but also because the judgment had a prejudicial impact on other ongoing disputes between the municipality and the Client.

The dispute, in which the judgment was issued, concerned only part of the claims brought by the municipality on the same grounds. The main amounts sought against the Client in other ongoing lawsuits (related to claims for payment for unauthorized use in other periods) totalled approximately 1.7 million PLN.

Following the final ruling issued by the Court of Appeal in Rzeszów, which confirmed the validity of the arguments presented by the Law Firm’s lawyers representing the Client, the municipality expressed its willingness to enter into settlement discussions aimed at ending the ongoing lawsuits.

Thanks to the dedication of the Law Firm’s advocates and attorneys, these negotiations were fully successful for the Client. As a result of the settlements, the ongoing legal proceedings were discontinued. An additional benefit from the settlement was the refund of court fees and advances on litigation costs paid by the parties to date.

This case clearly demonstrates the importance of adopting the right strategy and arguments at the early stages of a dispute, as they can prove crucial for further claims and settlements. It is also important to make procedural decisions that allow for cost savings.
