Comprehensive legal services for a project relating to healthcare tenders financed from the National Reconstruction Plan (KPO) and the contracts concluded as a result of those tenders

In June this year, we completed a project in which, since March 2025, we had been providing the Client with comprehensive legal services relating to the organisation and conduct of tender procedures in the healthcare sector, for projects co-financed from the National Reconstruction Plan (KPO). The scope of our services also included legal support in matters relating to the performance of contracts concluded with contractors selected through tender procedures.

As part of the first stage of our collaboration, we provided legal services relating to the preparation and conduct of tender procedures for contracts concerning:

• construction works relating to the extension and refurbishment of hospital buildings;
• supply of equipment, devices and fittings;
• modernisation of the website, including development, implementation and publication of information content relating to the project’s implementation.

The scope of services provided by the Law Firm’s lawyers during this stage included, amongst other things:

• the legal preparation of the full tender documentation, including the Terms of Reference (SWZ) together with annexes (including draft contracts with contractors) based on the specifications and data provided by the Client,
• legal support in tender procedures, including: selecting the appropriate procedure; estimating the price and publishing the tender in the Official Journal and on the public procurement portal; responding to bidders’ queries; selecting a bid/rejecting bids; and the process of signing contracts with the contractor selected in the tender procedure.

Subsequently, the Law Firm’s attorneys and advocates provided legal support to the Client during the implementation of contracts concluded with contractors selected through tender procedures. This scope of services included comprehensive legal support relating to the performance of the construction works contract concluded with the main contractor, as well as contracts concluded with suppliers and service providers, including, amongst others:

• providing legal advice in connection with legal uncertainties arising from the ongoing performance of the contracts,
• reviewing draft contracts with subcontractors and providing support in procedures relating to the notification of subcontractors to the client,
• reviewing and drafting submissions,
• preparing amendments to existing contracts and providing support in the process of concluding them,
• providing legal advice on the preparation of procedures for the acceptance of construction works and deliveries, including the drafting of acceptance documentation,
• assisting in the settlement of the investment and individual contracts.

The total value of the project, financed from the National Reconstruction Programme (KPO), amounted to approximately PLN 60,000,000.

Despite the short timeframe between the Client signing the grant agreement and the required deadline for completing the project, the project was completed with great success, which we achieved thanks to the full commitment of both the project team working on behalf of the Client and the Law Firm’s lawyers, as well as our collaborative partnership.

We are ready to undertake similar projects in the future.
