Developers will get additional time to implement investments under existing rules

By virtue of the Ordinance of the Minister of Development and Technology dated March 27, 2024 on amending the Ordinance amending the Ordinance on technical conditions to be met by buildings and their location, the effective date of the amended regulations governing technical conditions to be met by buildings and their location has been changed.
The amended regulations governing technical conditions to which buildings and their location should conform will come into force on August 1, 2024, rather than on April 1, 2024, as originally planned.
The existing regulations will apply to construction projects for which an application for a building permit will be filed before the effective date of the amended regulation, i.e. before August 1, 2024:
- an application for a building permit, an application for a separate decision on approval of a plot or land development project or an architectural and construction project, an application for an amendment to a building permit will be submitted,
- a decision on a building permit or a separate decision on approval of a plot or land development project or an architectural-construction project will be issued,
- a notification of construction or performance of other construction works will be made, in case a construction permit decision is not required,
- a decision on legalization referred to in Article 49 paragraph 4 of the Act of July 7, 1994 – Construction Law will be issued, and the decisions referred to in Article 51 (4) of the Law of July 7, 1994.
Entrepreneurs involved in residential construction, including above all developers, have therefore gained additional time in which it will be possible to carry out investments based on the existing regulations, and time to adapt solutions for further investment intentions with peace of mind to the new requirements.
