Final success in the case against GDDKiA (the General Directorate for National Roads and Motorways)

On May 23, 2013, before the Court of Appeals in Rzeszow, a judgment was issued dismissing the appeal of the State Treasury – General Directorate for National Roads and Motorways against the judgment favorable to the Law Firm’s Client, awarding in full the remuneration claimed in the lawsuit, amounting to more than half a million zlotys for the work performed as part of the investment task entitled “Construction of the Ropczyce bypass within the A4 (E40) national road Jędrzychowice – Korczowa from km 561+357 to km 565+454”.

The Court of Appeals deciding the case upheld in its entirety the findings of the Court of First Instance with regard to the existence of joint and several liability of the investor (GDDKiA) for the subcontractor’s obligations under Article 647(1) of the Civil Code.

An important circumstance in the case was the fact that the subcontractor did not have the written consent of the GDDKiA to carry out the scope of work assigned to it.
