Legal support for a contractor in preparing explanations regarding an abnormally low price.

The Law Firm’s lawyers provided legal support to a Client – a company operating in the building construction industry – in preparing explanations regarding an abnormally low price in a public procurement procedure. The subject of the tender was the comprehensive modernization of a complex of exhibition and storage buildings at a cultural facility in the Świętokrzyskie Province.

During the proceedings, the Law Firm’s attorneys, among other things:

• analyzed the content of the contracting authority’s request in the context of the entire tender documentation, as well as the calculations and materials provided by the Client;
• conducted a comprehensive analysis of the factual and legal situation in the area of public procurement to identify possible and effective arguments to demonstrate the validity of the Client’s position;
• drafted a response to the contracting authority, taking into account the need to protect information constituting the Client’s trade secrets.

The experience and expertise of the Law Firm’s lawyers enabled the Client to successfully conduct the clarification procedure before the contracting authority. The contracting authority accepted the explanations provided by the Client, as a result of which the Client was awarded a public contract worth over 20 million PLN.
