Remuneration for drilling exploratory boreholes – another dispute with General Directorate for National Roads and Motorways (GDDKiA)

Experience / 08.07.2026

Another company operating in the geological works sector has approached the Law Firm’s lawyers for legal assistance in a case concerning the settlement of remuneration owed to the company by the General Directorate for National Roads and Motorways (GDDKiA) for the drilling of exploratory boreholes necessary to determine the geological and engineering conditions on a site earmarked for the construction of an expressway.

This is yet another case in which the issue of how to settle the cost of exploratory boreholes—including the unit rates that should apply—remains in dispute between the geological contractor and the GDDKiA, in cases where, due to the presence of a rock ceiling in an exploratory borehole, it becomes necessary to change the drilling technology from that specified in the previously approved Geological Works Project.

As part of the cooperation to date, the Law Firm’s attorneys have carried out a detailed analysis of the contractual documentation and recommended to the Client the most optimal strategy for further action relating to the performance of the contract and the settlements made in connection with it. The Law Firm’s lawyers also participated in the preparation of submissions addressed to the GDDKiA.
