We resolved a dispute through a court settlement in which a construction works contractor was claiming nearly PLN 200,000 from our Law Firm’s Client, arguing that the parties had entered into an oral contract for construction works.
The claim pursued by the contractor in the case was disputed both in principle and in terms of the amount, as the Law Firm’s Client maintained that the works carried out by the contractor fell within the scope of a construction contract previously concluded between the parties and had been settled in full. The contractor, however, claimed that this was a different scope of works, the performance of which was to be agreed orally, as was the amount of remuneration due for them.
The parties decided to enter into settlement negotiations, and thanks to the commitment and legal advice of the Law Firm’s lawyers, an agreement was successfully reached.
Importantly, the comprehensive approach taken by the attorneys to the amicable settlement of all matters relating to the contractor’s performance of the works and their settlement led to a situation where the settlement reached not only resolved the issue of payment of the remuneration, but also resolved issues relating to the rectification of defects identified in the works carried out and the contractor’s provision of a warranty and guarantee for the scope of works completed.
Thanks to the support of the Law Firm’s lawyers, the Client concluded a satisfactory settlement which further safeguarded its interests.
