Success before the Voivodship Administrative Court in a case regarding variable fees for water services in the drainage of a mining plant

The Law Firm’s lawyers represent a Client engaged in open-pit mining operations in administrative appeal proceedings and judicial-administrative proceedings involving the Director of the Catchment Management Board of the State Water Holding “Wody Polskie“.

Currently, two cases are pending before the Voivodship Administrative Court in Kielce, resulting from the Client’s complaints about decisions concerning variable fees for water services related to the drainage of the Client’s mining plant. The Director of the Catchment Management Board of Wody Polskie classifies the drainage waters as industrial wastewater, while the Client argues that they are clean drainage waters from the mining plant.

In December 2024, the Voivodship Administrative Court in Kielce, after reviewing one of the Client’s complaints regarding the decision by the authority setting the variable fee for water services, annulled the contested decision and referred the case for reconsideration.

We are awaiting the written justification for the judgment, which will be crucial for the Client in the context of the other ongoing proceedings.
