The attorneys of the Law Firm represented a Client operating in the real estate development industry in a court dispute concerning a favourable decision on the zoning conditions for an investment project involving the construction of single-family terraced houses.
Complaints to the Voivodship Administrative Court were filed by several parties to the proceedings, alleging defects in the urban planning analysis prepared by the authority of first instance, violation of the principle of good neighbourhood and, in particular, improper recognition by the authorities that the planned investment is to include single-family development, as, according to the appellants, the characteristics of the planned buildings, the intensity of development, the architectural form and the dimensions of the planned investment imply multi-family development.
The Law Firm’s in-depth legal analysis of, inter alia, the issue of technical parameters of single-family development, resulting from court rulings in the field of construction law on the characteristics of such development, as well as the experience and full involvement of the Law Firm’s attorneys-at-law allowed us to unequivocally refute the arguments of the parties who challenged the administrative decisions of the first and second instance authorities which were favourable to the Law Firm’s Client.
This resulted in the accepting by the Administrative Court position presented by The Law Firm and dismissing all complaints in their entirety.
Thanks to the favourable ruling, the Law Firm’s Client may proceed to the next stage of investment implementation.
