Under the recent amendment to the Labor Code, employers will be able to introduce employee sobriety checks – or checks for the presence of substances acting similarly to alcohol – when this is necessary to ensure the protection of the life and health of employees, other persons or the protection of property. The employer will be obliged to not allow to work an employee in whose organism the presence of alcohol or a substance having a similar effect to alcohol has been detected. This will also apply if there is a reasonable suspicion that an employee has come to work in a state of drunkenness, under the influence of alcohol or of a substance having a similar effect to alcohol, or has consumed alcohol or taken such substances while at work.
