National geological service – changes

On October 28, 2023, the Law of June 16, 2023, on Amendments to the Geological and Mining Law and Certain Other Laws ( Dz.U. 2023 item 2029) partially entered into force.

Based on the amendment, changes were made to the regulations governing the activities of the national geological service (psg). An amendment was made to the provisions on the implementation of the psg’s tasks by the State Geological Institute – National Research Institute (PIG-PIB). As a result of the amendment, PIG-PIB will be authorized to carry out, on the basis of a geological works project, the recognition of the geological structure of the country and the determination of the resources of mineral deposits referred to in Article 10, paragraph 1 of the Geological and Mining Law.

In addition, as a consequence of the amendment to the regulations in the area of strategic deposits, the task of giving an opinion on deposits in terms of the possibility of considering them to be strategic has been imposed on the psg. The minister responsible for the climate and environment, after approving geological documentation covering deposits specified in Art. 10(1) of the Geological and Mining Law, will decide in each case whether it is justified to initiate proceedings to recognize a deposit as strategic.
