The Regional Court in Krakow fully agreed with the position of the Law Firm’s lawyers expressed in the appeal filed on behalf of the defendant, and approved that the plaintiff is not entitled to a claim for interest at the statutory rate on the bonus remuneration paid late, which, as a result of later findings, turned out to be unjustified, even if the payment of the remuneration was made on the basis of an invoice previously accepted by the defendant. Considering the plaintiff’s payment of remuneration as undue, the Court of First Instance was obliged to assume that it was unmatured, and therefore that no interest could be claimed on such payment.
