With the Ordinance of the Minister of Family and Social Policy of May 11, 2023, amending the Ordinance on the labor certificate ( Dz.U. 2023 item 912), changes were made to the new content that should be included in the labor certificate issued to employees after that date.
According to the amended labor certificate ordinance, employers are required to include the following new information on:

care leave taken in the calendar year in which the employment relationship ended;

the employee’s exemption from work due to force majeure for urgent family matters caused by illness or accident, used in the calendar year in which the employment relationship ceased;
-
the period of performance of occasional remote work in the calendar year in which the employment relationship ceased.
All of the aforementioned changes came into effect as of May 23, 2023.
The amending ordinance also introduced a new template for the labor certificate. According to established practice and positions presented in the doctrine, this template cannot be freely modified by omitting some of the elements required by this template.
This does not mean that the employer must use the template of the labor certificate attached to the Ordinance of the Minister of Family, Labor and Social Policy of December 30, 2016 on the labor certificate, as it is possible to develop an “own” template, which, however, must contain all the elements required by the above-mentioned Ordinance and the Labor Code.
